Must open the flood gates, surely?

We should have realised really.............this is what he usually does. Pays out with the silence proviso.

Now I know it will be a drop in the ocean to you Hump, but I bet it still hurts. Giving payouts to the peasants. Whatever next?

We shall never know. ???

Unless the claimants are willing to give up, Humphrey's victory and the dosh, over  the confidentiality clause and fight on, for total victory for the alleged oppressed. Seem to remember reading on this site that they would never be 'gaged'? :-\

No judgment has been made. NO judgment on how many hours the down trodden managers must work.

UNITE do not have a definitive answer to any of the concerns as NO judgment and therefore NO precedent has been set, that can be used in future cases. Therefore if anyone else needs to fight they must go through the whole process again? 18 months i think this episode took?

Dave Daly, Licensees Unite National Committee member, said: ?We are prepared to go to a tribunal. We all need to know what we can and can?t do.

NOT GOING TO FIND OUT NOW ARE WE?

?The pubcos don?t want to go to a tribunal over this because it will set a precedent.?

This week Unite called for a 48-hour working week for all pub managers, plus a minimum 25 days? annual holiday and more protection from violence.

THE NALHM 'CALLED' FOR THAT 10 YEARS AGO

Jennie Formby, Unite?s national officer for the hospitality sector, said: ?Working 60 to 70 hours a week is just not acceptable and the health of our members is suffering.?

AND THE NEXT MOVE IS? cos BIG H WILL NOT RECOGNISE YOU.

?Our officials have reported a significant increase in cases of ill health retirement over recent years as pub chains cut costs forcing managers to operate with fewer staff, and we see a direct link with the long hours they work.?

WHO WINS, WHO LOSES COMMENTS PLEASE?

Well put.

We know he must have had a good idea he was going to lose, and there is some sort of victory in there, but it would have been so much better to go all the way.
However, I can understand people taking the way out they have.

But overall, can't disagree with you.

Is the Morning Advertiser story actually about Sam Smiths?

It refers to 3 managers only, whereas there were about 9 in the Sams case. Also I thought this was an unfair dismissal issue, not about the working time directive. Finally the MA story refers to ''companies'' i.e. more than one, and to ''pubco's'' which are not normally brewers but pub owners.

8 win tribunal cases!

I've just been informed that 8 management couples have won their unfair dismissal cases against H Smith! No doubt Humphs will probably still believe that he is in the right - when really it should be a wakeup call - to start accepting the mistakes he's made, and start listening to the many voices who are offering genuine experienced advice - of a positive, constructive nature!

 :D
Always in support of the Samuel Smiths Brewery - although very concerned about the current company strategy towards its staff and customers, as exercised by the Directors. We believe in promoting common sense, decency, compassion, fairness and compliance with company, employment and English law.

So glad the managers have won,but is that it no details of anything !It appears we will all be left in the dark as to the actual outcome or is someone going to have the balls to speak out !!! It seems a pity considering the encouragement these managers have had from this site.

It looks like I might be one of the first to say how pleased I am for the individuals involved - but sadly agree that if HS is true to form he will tend to blame everyone else for losing the cases, rather than acknowledge that it was an error of judgement on his part. Hopefully it will generate some media attention though and help to pile a bit of pressure on......

Can I ask, did you ever receive compensation for this?

You will need to read several previous posts to get the full story, but briefly the brewery appealed and won. So unfortunately no compensation.
