Apparently there is also the Grandfather Licence which allows one Personal Licence holder to be DPS for three pubs. There are personal licence holders for SS who are DPS for more than three pubs which is not supposed to happen.

Guidelines from licencing authorities all say that the DPS must have substantial contact with the premises.  They imply that it is difficult to be the DPS of two pubs let alone 3.

Not heard of a Grandfather Licence before though only "grandfather rights" that refer to the premises licence.  Does a grandfather licence depend on the licencing authority?

Not sure how the Grandfathes licence is allocated. My other half has told me about it and is a bit miffed that although he has he personal licemce, someone else is DPS for his pub.

You are right about the "grandfather rights" . I think most, if not all, Sam's pubs have them on account of the licence not being changed i.e. no late licence requests or music requests etc.
Saucy queen, the personal licence doesn't automatically mean you become a dps.  A dps is the same as the old landlord/landlady position.

There is lots of guidance about DPS' on local authority websites such as http://www.scarborough.gov.uk/pdf/DPS%20Fact%20Sheet.pdf

The following are lifted from the above:

"The Licensing Authority hopes and anticipates that that the DPS will spend a significant amount of time on the premises, as the guidance suggest that the DPS should be someone who has ?day to day responsibility for running the premises?."

"... if you are going to be the DPS for more than one premises, you would need to carefully consider whether you are able to fulfil the requirements laid down in the guidance."

"The DPS will be easily identifiable, as both the Premises Licence and Summary (this is a shortened version of the Premises Licence) specify the name of the DPS. The Summary of the Premises Licence has to be prominently displayed at the premises."

You can have several Personal Licence Holders but only one DPS and each premises should have a premises licence detailing the hours they can open etc.

Each of these has a cost implication, hence Humph's reluctance to change anything.  The premises licences, are nearly all from the previous licencing laws when the old opening hours just moved across.  I've been told that to change these can be quite costly and may involve use of a legal company.  Also probably accounts for some differences in all day opening at weekends.

If I remember correctly it costs between ?150.00 and ?200.00 to change the license.  It's not hard to do and shouldn't really need the involvement of legal advice, bar the first time and the odd difficult case.

The cost to change the DPS on a Premises Licence is ?23.  The cost of varying a Premises Licence can be anything from ?100 - ?1905 depending on the rateable value of the premises, and the annual cost ranges from ?70 to ?1050. These charges should be applied by every licensing authority but some (strangely enough!) have been known to try and get away with more.

heard SS got a visit from licensing in london area today re his failure to update DPS and personal licence holders, not yet got it right, if you are the licence holder then make sure the DPS is right it comes back to haunt you otherwise

Guidance from the Department for Culture Media etc says "The DPS must inform the relevant licensing authority  if he or she wishes to be removed as DPS. Within 48 hours of the notice being given to the licensing authority, the individual must also give the premises licence holder a copy of the notice sent to the licensing authority. The DPS must also send a notice directing the licence holder to send to the relevant licensing authority the premises licence or if that is not practicable, a statement of the reasons for the failure to provide the licence within 14 days of receiving the notice.

If the holder fails to comply with the direction he will commit an offence."

You may find out that you are still named as DPS after you have left.  Licensing authorities do random checks as well as checking on premises where there has been a problem. 

However, I have been informed that the main onus is on the premises license holder (SS).

Heard today that there have been several people looking at the brewery this week.Do they know what they are letting themselves in for. Anyone else heard anything?

8 of the 32 new managers are supposed to have already been sacked... allegedly another 20 in training this week...can  anyone confirm this

My daughter and son -in-law were on the course having had to run a pub for 5 weeks before they were trained. While on the course they were still required to open their pub at lunchtimes  using the part time 'unqualified' staff and to return to their pub in the evening to open 'as usual', no day off at all that week and working better than 14 hour days. There were only a few people turned up for the course, certainly not the 32 for whom places were booked, it would appear that quite a few couples 'saw the light' early. And so well organised is Smith that having completed the course, on the last day, one couple were sacked on some quite improbable pretext! Does the man spend his life sitting on that part of his anatomy where his brain is situated? Heard that Humph is back in the mental home once again and so he should be. The real question is why they keep letting the idiot out!!

I understand that there are another 25 - 30 new managers in training at the brewery this week. Hhumphrey must still have alot of vacancies in his pub estate.

I have wondered this myself, there carn't be anyone out there has not heard of how badly this brewery treats managers. But they still seem to queue outside the brewery for a job.

They probably think any job is better than no job.  They'll soon learn they'd be better with no job.
